Accessing and using the SecondBook platform implies full acceptance of these Terms of Service. If you do not agree with them, you must refrain from using the platform.
SecondBook is a digital platform that acts as an intermediary between users who want to sell accommodation reservations and other users interested in purchasing them. SecondBook is not an accommodation provider nor a travel agency, but facilitates the listing, verification, payment management and coordination of the reservation transfer process.
To use certain features, you will need to create an account. The user agrees to: ā¢ Provide truthful and up-to-date information ā¢ Maintain the confidentiality of their credentials ā¢ Not use the platform for fraudulent purposes The user is responsible for all activity carried out from their account.
Sellers may list accommodation reservations on the platform. The seller declares and warrants that: ā¢ The reservation is real and valid ā¢ They have the right to dispose of it ā¢ The information published is truthful ā¢ The reservation can be transferred (or accepts that it will be verified) SecondBook may review, validate or reject any listing.
The buyer may purchase a reservation through the platform. SecondBook will manage the process to facilitate the transfer of the reservation, including: ā¢ Verification of the reservation ā¢ Coordination of the name change ā¢ Communication between the parties when necessary The transaction will be considered complete when the reservation is correctly in the buyer's name.
The payment made by the buyer will be held securely until the correct transfer of the reservation is confirmed. Once the transfer is completed: ā¢ The payment will be released to the seller ā¢ The estimated receipt time is 7 to 10 business days If the transfer cannot be completed, the buyer will receive a full refund.
Listing a reservation on SecondBook is free. In case of a sale, a commission will be applied to the seller of: ā¢ 10% of the sale price + VAT ā¢ With a minimum of ā¬15 + VAT No fees apply to buyers.
Users agree to: ā¢ Not publish false or misleading information ā¢ Not use the platform for fraudulent activities ā¢ Not attempt to bypass the platform to close transactions outside of it ā¢ Respect the conditions of the original provider (hotel, accommodation, etc.) Truthfulness of reservations The seller guarantees that the information provided about the reservation is truthful, complete and up to date. If the information is false or inaccurate, SecondBook may cancel the operation and suspend the user's account. Fraud prohibition It is strictly forbidden to list non-existent or manipulated reservations, or any reservation the user has no right to dispose of. SecondBook reserves the right to block, cancel or remove any content suspected of fraud. Mandatory process Users agree to complete transactions within the platform. It is not allowed to attempt to close operations outside SecondBook to avoid fees. Payment retention SecondBook may retain the payment until the correct transfer of the reservation to the buyer is confirmed. In case of incidents, it may temporarily suspend the payment until resolved. Dispute resolution In case of a conflict between buyer and seller, SecondBook may intervene to analyse the situation and make a decision based on available information. This decision will aim to guarantee the safety of the transaction. Misuse SecondBook may suspend or cancel accounts that misuse the platform, including fraudulent, abusive or harmful behaviour towards other users.
SecondBook acts as an intermediary in the transaction and is not a provider of the accommodation service. Therefore: ā¢ It does not guarantee the conditions of the accommodation ā¢ It is not responsible for changes, cancellations or incidents caused by the hotel ā¢ It is not responsible for incorrect information provided by users Nonetheless, SecondBook implements verification and payment protection measures to minimise risks.
If the transfer of the reservation cannot be completed as described in the listing: ā¢ The buyer will be entitled to a full refund Once the reservation has been correctly transferred, no cancellations or refunds will be accepted.
SecondBook reserves the right to suspend or cancel accounts in case of: ā¢ Breach of these terms ā¢ Fraudulent use of the platform ā¢ Activities that may harm other users or the platform
SecondBook may modify these Terms of Service at any time. Changes will be published on the platform and will take effect from the moment they are published.
These Terms are governed by Spanish law.
